Referral Fees

Many of our clients will have found that when contemplating certain types of transaction they are put under great pressure to instruct other solicitors.  Such pressure typically comes from an estate agent or financial advisor who seeks to persuade the client that this other firm will be quicker/more efficient/cheaper and that it will be much better for the client to use that firm rather than Pengillys.  In almost every case the person seeking to persuade clients is motivated not by concern for the welfare of the client but by financial considerations because the other solicitors who are recommended buy these recommendations by paying a referral fee for every case sent to them by the estate agent or financial advisor.  Almost without exception the solicitors or conveyancers who are recommended on house sales or purchases are factory conveyancing firms where the work is done by unqualified personnel with little or no legal training using a computer system which flags up daily reminders and prepares some standard documentation.  Contrary to the recommendations given these firms are invariably slow and inefficient.  Although they may have long opening hours calls are taken by any one of a team, none of whom has any more information about the file than is apparent from the computer screen in front of him and the result of using these firms is invariably delay and frustration and almost every client who has spoken to us about this has said they would never use such a firm again.

We would ask all our clients to bear this in mind when being put under pressure to instruct a firm from another part of the country instead of Pengillys and to remember that the motivation for that recommendation is purely financial and that the service which is promised invariably fails to live up to expectation.
