Co-habitation

There are many myths surrounding the rights of co-habiting couples, irrespective of how long they have lived together or whether they have children.

A Cohabitation Deed (or living together agreement) may assist. Cohabiting couples can enter into a Deed, which may be legally binding. We advise on how the law affects their rights, particularly relating to property, other assets and children, in the event of separation or death.

One of the very common misconceptions is the principle of 'common law wife'. Currently there is no defining piece of legislation to the rights and responsibilities of cohabiting couples. Various forms of legislation impact, including: -

Family Law Act 1996
Trusts of Land and Appointment of Trustees Act 1996
